“Don’t Trust the Insurance Company” – Good Advice from Experienced Motorcycle Lawyers at The Law Offices of Adrian Crane

Insurance companies are in the business of making money for their shareholders; they generally have very little to no obligation to pay fair amounts of money to settle claims made by motorcyclists who have been injured by their insureds.

When they are faced with a substantial financial loss in the situation where their insureds have caused a motorcycle accident, their concern is only in closing the case for as little money as is possible; their goal is to get the claimant to sign a release.

We Provide a Winning Combination of Resources, Experience, Patience and Determination for People Who Have Sustained Injuries in Motorcycle and Car Accidents.

The adjuster for the insurance company will almost always first look for someone else to blame for the accident.  Then they will look for some way to make it look like the accident wasn’t that serious.  Then they do everything they can to minimize your injuries. They do everything they legally can in an effort to settle the case for as little money as is possible.

An experienced and aggressive motorcycle accident and personal injury lawyer understands how insurance company claims adjusters work and operate; they protect you from unethical and unfair practices of the insurance company’s adjusters.

According to the U.S. Department of Transportation’s National Highway Traffic Safety Administration, motorcyclists are 35 times more likely to experience a deadly accident on the road than those in cars.

Almost 15 percent of all accidents that occur on the roads in the United States involve motorcycles.

Almost 90,000 motorcyclists are injured in highway accidents every year.

Almost 5,000 motorcyclists are killed every year in road accidents.

Head injuries are the leading cause of death in motorcycle accidents.

Wrongful Death Cases and Motorcycle and Car Accident Personal Injury Lawyers in Dallas Texas – Since 1991

In 2005, the motorcycle fatality rate was about 75 per 100,000 motorcycles on the road; meanwhile, the passenger vehicle fatality rate in the same year was about 15 per 100,000 cars.

Growth of motorcycle fatalities is growing disproportionately to growth in motorcycle use.  In 1997 there were almost 4 million motorcycles registered in the U.S. and about 2,100 motorcycle fatalities.  In 2005, there were about 6 million motorcycles registered in the U.S. and about 4,800 motorcycle fatalities.  So, between 1997 and 2005, registrations grew 63 percent while fatalities grew by more than 100%.

In 2009, The Insurance Institute for Highway Safety’s Highway Loss Data Institute report found that:

More than half of all motorcyclist deaths involve at least two vehicles.

About 40 percent of two-vehicle fatal motorcycle crashes involved a vehicle turning left while the motorcycle was about to pass the vehicle.

About half of all motorcycle deaths involved no other vehicle.

Of the 1,791 motorcycle deaths that involved only the motorcyclist, almost half were speeding; about 40 percent had blood alcohol concentrations of at least 0.08 percent.

Possible Causes of a Motorcycle Accident

Disobeying speed limitations;
Driving on the wrong side of the road;
Driving while under the influence of alcohol;
Driving while under the influence of drugs;
Ignoring traffic conditions;
Ignoring road conditions;
Ignoring traffic control signals and signs;
Ignoring stop signs;
Ignoring yield signs;
Inexperienced motorists and motorcyclists;
Intentionally hostile actions:
Lane splitting, i.e. when a motorcyclist drives between two lanes;
Not stopping in time to prevent a rear end collision;
Not seeing a motorcyclist due to glare or other view obstructions;
Not using a turn signal;
Passing when illegal or unsafe;
Poor weather conditions;
Speeding;
Roadway defects;
Vehicle defects;

Although helmets can save lives, motorcyclists have little protection in an accident.  In fact, the primary reason for serious motorcycle accidents where death and severe injuries occur is that motorcycles offer little protection when a collision occurs, like passenger vehicles do.

Helmet Statistics

While we believe that motorcyclists should be free to wear a helmet or not, the truth is that helmets do save lives.

Wearing helmets is in fact the single best way to prevent motorcycle accident fatalities.

The latest statistics show that about 45% of all individuals killed in a motorcycle accident were not wearing helmets.

The National Highway Traffic Safety Administration (NHTSA) determined that almost 1,900 lives were saved in 2008 because riders were wearing helmets.  They believe that more than 800 additional victims would have lived had they been wearing a helmet.

Texas is one of the states that has repealed a mandatory helmet law.  Others include Arizona, Arkansas, Florida, Illinois, Iowa, Louisiana, Michigan, Kentucky and Pennsylvania.

Unfortunately, according to the Governor’s Highway Safety Association, helmet use drops significantly when helmet use is repealed.

Fatalities increased in all seven states that repealed helmets laws.  Fatalities in Louisiana more than doubled.

Overall, nationwide helmet usage has increased. As a result, motorcycle accident fatalities have dramatically decreased.

More Alcohol and Motorcycle Accident Statistics

In 2010, the NHTSA stated that a total of 29% of all fatal motorcycle accidents involved riders with a blood alcohol level above .08, which is the national legal limit.

One in every three motorcycle accidents was a result of riding under the influence of alcohol.

According to the Centers for Disease Control and Prevention (CDC) young adults between the ages of 20 through 24 have the most alcohol-related motorcycle crashes.

Close to 4% of all victims involved in a fatal motorcycle accident had at least one prior conviction for an alcohol related road infraction.

Speeding and Motorcycle Accident Statistics

According to the NHTSA, almost 40% of all motorcycle accidents in involved speeding.

Approximately 35 of all fatal motorcycle accidents were caused by speeding.

Approximately half of all motorcycle accidents are single accident crashes; no other vehicle is involved.  Excessive speed is usually the cause of single accident motorcycle accidents.

The Governor’s Highway Safety Association believes that stronger enforcement of speeding laws in high-target areas will reduce motorcycle accidents and fatalities.

Motorcyclists speeding while not wearing a helmet at least double their risk of a fatal motorcycle accident.
